DTE Shenango Coke

UPDATE: Shenango Coke stopedp producing coke in mid-January of 2016 and will completely shut down in the first half of 2016, due to the downturn in the North American steel industry.

On February 6, 2014, GASP issued Shenango a 60-day Notice of Intent to Sue, for violations of the Federal Clean Air Act and/or Article XXI of the Allegheny County Health Department’s (ACHD) Rules and Regulations. On April 8, 2014 we received word that the County and Shenango entered into a consent agreement. Read the consent agreement. (On September 5, 2014 an amendment was filed to the consent agreement.)

We have found the agreement to be lacking in several areas and on May 8, 2014 we filed a citizens’ suit to address the issues.

Shenango filed a motion to dismiss the lawsuit, and we filed an opposition to that motion on August 7, 2014. A judge granted the dismissal in late March 2015, and on April 23, 2015 we appealed that decision.

On July 6, 2015, several organizations motioned for leave to file an amici brief in support of GASP. The legal proceedings ended in January 2016.

As you’ll see in the list of news articles below, the coke plant on Neville Island has been an issue for years. GASP sends Smoke Readers to observe the facility, and is working with Clean Water Action, Allegheny County Clean Air Now, and other partners to keep pressure on the facility and the county health department to ensure air emissions violations end.
